                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Provides that on and after January 1, 1996, Oregon Trail
registration plate will be only plate issued. Allows people with
' tree' plates to transfer them to other vehicles.

                        A BILL FOR AN ACT
Relating to registration plates; creating new provisions;
  amending ORS 803.535, 803.575 and 805.242; and repealing ORS
  803.538 and sections 1, 2 and 3, chapter 572, Oregon Laws 1987.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 803.535 is amended to read:
  803.535. Subject to ORS 805.205 and the following, the
Department of Transportation shall select registration plates it
issues:
  (1) Registration plates shall be in the size, form and
arrangement and made of materials determined by the department
subject to the following:
  (a) Except as otherwise provided in paragraph (f) of this
subsection,   { - the design of the - }  registration plates
shall be   { - that chosen by the commission from entries in the
contest held pursuant to chapter 572, Oregon Laws 1987 - }
 { + the Oregon Trail commemorative plates designed in accordance
with the provisions of section 113, chapter 741, Oregon Laws
1993 + }.
  (b) If registration plates are issued, means shall be provided
for identifying the vehicle from the front and rear by means of
characters or numerals.
  (c) All plates shall be made with a reflective material, so as
to be a fully reflectorized safety plate. The reflectorized
material shall be of such a nature as to provide effective
dependable brightness in the promotion of traffic safety during
the service period of the plate issued.
  (d) Except as otherwise authorized under ORS 805.200, all
plates shall contain the distinctive number or characters
assigned to the vehicle and the word 'Oregon.  '
  (e) When a pair of registration plates is issued, each plate
shall bear the same identification as the other plate of the
pair.
  (f) The department may   { - choose plates for - }
 { + determine by rule categories of + } vehicles that are not
required to display plates from the   { - series produced as
provided in chapter 572, Oregon Laws 1987 - }   { + Oregon Trail
commemorative series. The department may choose plates for such
vehicles + }.   { - Nothing in this paragraph prohibits the
department from issuing plates from the series produced as
provided in chapter 572, Oregon Laws 1987, for vehicles that are
not required to display such plates. - }
  (2) The department may provide for designation of the
registration period for which the registration is issued on the
plate by means of stickers described under ORS 803.555 or any
other method the department determines appropriate.
  (3) The department may provide plates that may be used on a
vehicle for successive registration periods when validated by one
or more stickers described under ORS 803.555.
  SECTION 2. ORS 803.575 is amended to read:
  803.575. (1) The fee for issuance of a duplicate or replacement
registration card under ORS 803.510 is $5.
  (2) The fee for issuance of a replacement or duplicate
registration plate under ORS 803.530 is the fee established under
ORS 803.570, together with a fee of $11.
  (3) The fee for transfer of registration plate under ORS
803.530 or 803.590 is $6.
  (4) The fee for issuance of replacement registration stickers
under ORS 803.555, is $11.
  (5) The fee for issuance of both replacement or duplicate
registration plates and replacement registration stickers, when
issued at the same time, is $11, in addition to the fee
established under ORS 803.570.
  (6) The fee paid under subsections (2), (4) and (5) of this
section includes the cost of any duplicate or replacement
registration card issued.
   { +  (7) The fee for receiving an 'Oregon Trail' plate at the
same time that the person renews the registration of the vehicle
that will carry the plate is $1.50 in addition to any other fee
authorized by law. + }
  SECTION 3.  { + Section 4 of this Act is added to and made a
part of ORS chapter 803. + }
  SECTION 4.  { + Notwithstanding ORS 803.530 (1), registration
plates from the series produced as provided in chapter 572,
Oregon Laws 1987, as supplemented by ORS 803.538 (1993 Edition),
may be transferred to another vehicle as though they were plates
from the current issue of plates. + }
  SECTION 5. ORS 805.242 is amended to read:
  805.242. Notwithstanding ORS 803.530 (1), the Department of
Transportation shall approve a request to transfer registration
plates that are not from a current issue of plates  { + and are
not from the series issued as provided in chapter 572, Oregon
Laws 1987, as supplemented by ORS 803.538 (1993 Edition), + } if
the owner of the plates submits an application for transfer along
with the plate transfer fee and the fee for a customized
registration plate established in ORS 805.250, in addition to any
required registration fee. Upon transfer of the plates, the
plates shall for all purposes be considered customized
registration plates issued as provided in ORS 805.240.
  SECTION 6.  { + ORS 803.538 and sections 1, 2 and 3, chapter
572, Oregon Laws 1987, are repealed. + }
  SECTION 7.  { + Except as otherwise provided in this section,
the provisions of this Act become operative on January 1, 1996,
and the 'Oregon Trail' plate becomes the current issue of plates
on that date. If the Department of Transportation determines that
supplies of the 'tree' plate will be depleted such a short time
before January 1, 1996, that it would be economically imprudent
to order new 'tree' plates, then the department may issue the '
Oregon Trail' plate as its current regular issue prior to January
1, 1996. Notwithstanding section 113, chapter 741, Oregon Laws
1993, the department may not collect a surcharge for 'Oregon
Trail' plates if they are issued as current regular plates prior
to January 1, 1996, for reasons described in this section. + }
