A BILL FOR AN ACT Relating to boat accident reporting; amending ORS 830.480. Be It Enacted by the People of the State of Oregon: SECTION 1. ORS 830.480 is amended to read: 830.480. (1) The operator of any boat involved in an accident resulting in injury or death to any person or damage to property in excess of the dollar amount established by rule of the { + State Marine + } Board shall make a report of the accident to the board in such form and manner as the board by rule may prescribe. (2) Whenever a report is insufficient in the opinion of the board, it may require the operator to file a supplemental report and may also require a witness to the accident to render a report to the board. (3) Whenever the operator of a boat is physically incapable of making a required accident report and there was another occupant in the boat at the time of the accident capable of making a report, the occupant shall make { + the report + } or cause the report to be made. { + (4) Upon receipt of a claim under a policy of insurance with respect to a collision, accident or other casualty for which a report is required by subsection (1) of this section, the insurer shall: (a) Notify the insured of the requirements of subsection (1) of this section and of the rules adopted by the board. (b) Send a copy to the board of the notice required under paragraph (a) of this subsection. (5) If the board does not receive a report of the accident as required by subsection (1) of this section, the board shall provide one notice to the insured of the requirements of subsection (1) of this section. (6) The board shall assess a penalty fee of $250 upon renewal of a certificate of number for any owner who fails to report a boating accident, after being given notice pursuant to subsections (4) and (5) of this section. The penalty is in addition to the certificate of number fee required by ORS 830.790. (7) If the operator does not or is unable to file the report of accident as required by subsection (1) of this section, the owner may file the report. + } ----------
