                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to

brief statement of the essential features of the measure as
introduced.

  Increases penalty for public indecency when conduct consists of
masturbating in presence of child. Punishes by maximum
imprisonment of five years, $100,000 fine, or both.
  Creates crime of bestiality. Punishes by maximum imprisonment
of five years, $100,000 fine, or both.

                        A BILL FOR AN ACT
Relating to crime; creating new provisions; and amending ORS
  163.465.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 163.465 is amended to read:
  163.465. (1) A person commits the crime of public indecency if
while in, or in view of, a public place the person performs:
  (a) An act of sexual intercourse; or
  (b) An act of deviate sexual intercourse; or
  (c) An act of exposing the genitals of the person with the
intent of arousing the sexual desire of the person or another
person.
  (2) { + (a) Except as otherwise provided in paragraph (b) of
this subsection, + } public indecency is a Class A misdemeanor.
   { +  (b) Public indecency is a Class C felony if the conduct
engaged in consists of masturbating in the presence of a person
under 18 years of age. + }
  SECTION 2.  { + (1) A person commits the crime of bestiality if
the person engages in sexual activities with an animal.
  (2) Bestiality is a Class C felony.
  (3) As used in this section:
  (a) 'Animal' has the meaning given that term in ORS 167.310.
  (b) 'Sexual activities' includes, but is not limited to,
copulation, contact between the sexual parts of the person and
the vagina, mouth or anus of the animal and causing the animal to
contact the sexual parts of the person. + }
