                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Establishes program to reduce energy consumption in state-owned
facilities. Defines terms. Allows Director of Oregon Department
of Administrative Services to adopt rules to allow private
investment in energy conservation measures for state-owned
facilities.

                        A BILL FOR AN ACT
Relating to energy conservation.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + The Legislative Assembly finds and declares
that the facilities and equipment owned by state government
consume significant amounts of energy and that energy
conservation actions to provide for efficient energy use in these
facilities and equipment will reduce the costs of state
government. In order for the operations of state government to
provide the citizens of this state an example of energy use
efficiency, the Legislative Assembly further finds and declares
that state government should undertake an aggressive program
designed to reduce energy use in state-owned facilities and
equipment within a reasonable period of time. + }
  SECTION 2.  { + It is the purpose of sections 1 to 5 of this
Act to require energy audits in state-owned facilities, to
undertake such modifications and installations as are necessary
to maximize the efficient use of energy in these facilities and
to establish a policy for the purchase of equipment and materials
that results in efficient energy use by the state. + }
  SECTION 3.  { + As used in sections 1 to 5 of this Act:
  (1) 'Cost-effective' has the meaning given in ORS 276.905.
  (2) 'Director' means the Director of the Oregon Department of
Administrative Services.
  (3) 'Energy audit' means a determination of the energy
consumption characteristics of a facility that consists of the
following elements:
  (a) An energy consumption survey that identifies the type,
amount and rate of energy consumption of the facility and its
major energy systems. The survey shall be made by the agency
responsible for the facility.
  (b) A walk-through survey that determines appropriate energy
conservation maintenance and operating procedures and indicates
the need, if any, for the acquisition and installation of energy
conservation measures. This survey shall be made by the agency
responsible for the facility if it has technically qualified
personnel available. The Director of the Oregon Department of
Administrative Services shall provide technically qualified
personnel to the responsible agency if necessary.
  (4) 'Energy conservation measure' means an installation or
modification of an installation in a facility that is primarily
intended to reduce energy consumption or allow the use of an
alternative energy source, including:
  (a) Insulation of the facility structure and systems within the
facility;
  (b) Storm windows and doors, multiglazed windows and doors,
heat absorbing or heat reflective glazed and coated window and
door systems, additional glazing, reductions in glass area and
other window and door system modifications;
  (c) Automatic energy control systems;
  (d) Equipment required to operate variable steam, hydraulic and
ventilation systems adjusted by automatic energy control systems;
  (e) Solar space heating or cooling systems, solar electric
generating systems or any combination thereof;
  (f) Furnace or utility plant and distribution system
modification including replacement burners, furnaces and boilers
that substantially increase the energy efficiency of the heating
system, devices for modifying flue openings that will increase
the energy efficiency of the heating system, electrical or
mechanical furnace ignitions systems that replace standing gas
pilot lights and utility plant system conversion measures
including conversion of existing oil and gas-fired boiler
installations to alternative energy sources;
  (g) Caulking and weatherstripping;
  (h) Replacement or modification of lighting fixtures to
increase the energy efficiency of the lighting system;
  (i) Energy recovery systems; and
  (j) Any other measure that is recommended as cost-effective in
the energy audit.
  (5) 'Energy conservation maintenance and operating procedure'
means modification in the maintenance and operations of a
facility and any installations within the facility that are
designed to reduce energy consumption in the facility and that
require no significant expenditure of funds.
  (6) 'Facility' means a building, a group of buildings served by
a central energy distribution system or components of a central
energy distribution system.
  (7) 'Implementation plan' means the annual tasks and budget
required to complete all acquisitions and installations necessary
to satisfy the recommendations of the energy audit. + }
  SECTION 4.  { + The Director of the Oregon Department of
Administrative Services, in cooperation with the Department of
Energy, shall conduct, by contract or other arrangement, an
energy audit for each state-owned facility. All energy audits
shall be coordinated with and complement other governmental
energy audit programs. The energy audit for each state-owned
facility in the capitol group of buildings, as defined in ORS
276.010, shall be completed on or before July 1, ____, and the
results and findings of each energy audit shall be compiled and
transmitted to the Governor and the Legislative Assembly no later
than October 1, ____ . For every other state-owned facility, the
energy consumption surveys shall be completed no later than
October 1, ____ , and the walk-through surveys shall be completed
no later than July 1, ____. + }
  SECTION 5.  { + (1) Upon completion of each walk-through survey
required by section 4 of this Act, the Director of the Oregon
Department of Administrative Services or the agency responsible
for the facility if other than the Oregon Department of
Administrative Services shall implement energy conservation
maintenance and operation procedures that may be identified for
any state-owned facility. These procedures shall be implemented
as soon as possible but not later than 12 months after the
walk-through survey.
  (2) On or before ___, for the capitol group of buildings, as
defined in ORS 276.010, the director, in cooperation with the
Director of the Department of Energy, shall prepare and transmit
to the Governor and the Legislative Assembly an implementation
plan.
  (3) On or before ___, for all other state-owned facilities, the
Director of the Oregon Department of Administrative Services, in
cooperation with the Director of the Department of Energy, shall
prepare and transmit to the Governor and the Legislative Assembly
the results of the energy consumption and walk-through surveys
and a schedule for conducting technical assistance studies. This
submission shall include the energy conservation measures planned
for installation during the ensuing biennium. In scheduling
technical assistance studies, the Director of the Oregon
Department of Administrative Services shall consider energy
efficiency of a facility, responsible agency participation,
comparative cost and type of fuels, possibility of outside
funding, logistical considerations such as possible need to
vacate the facility for installation of energy conservation
measures, coordination with other planned facility modifications,
and the total cost of a facility modification, including other
work that would have to be done as a result of installing energy
conservation measures. Energy conservation measure acquisitions
and installations shall be scheduled to be 25 percent complete by
___ , or at the end of the biennium beginning July 1, ___,
whichever is later, 55 percent complete by ___, or at the end of
the biennium beginning July 1, ___, whichever is later, and 85
percent complete by ___, or at the end of the biennium beginning
July 1, ___, whichever is later. Each state agency shall
implement energy conservation measures that are cost-effective.
  (4) For each biennium until all measures are installed, the
Director of the Oregon Department of Administrative Services
shall report to the Governor and the Legislative Assembly the
progress of the installation, measures planned for installation
during the ensuing biennium and changes, if any, to the technical
assistance study schedule.
  (5) The director shall adopt rules to facilitate private
investment in energy conservation measures for state-owned
facilities consistent with state law.
  (6) As used in this section, 'technical assistance study '
means an intensive engineering analysis of energy conservation
measures for the facility, net energy savings and a
cost-effectiveness determination. + }
