                             SUMMARY

  Requires warning sign when pesticide is applied to specified
public property.

                        A BILL FOR AN ACT
Relating to pesticides.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) Any person who applies pesticide to public
property where public exposure is foreseeable shall post a
warning sign. The sign shall be in English and Spanish and shall
contain a warning that the area has been treated with a pesticide
and that individuals are not to enter the area.
  (2) This section applies to all pesticide applications that
have worker reentry intervals of at least 24 hours.
  (3) The warning sign required under this section shall be:
  (a) Posted immediately prior to pesticide application;
  (b) Posted at regular intervals and at all regular points of
public entry; and
  (c) Removed within 24 hours after the expiration of the reentry
interval.
  (4) The public agency responsible for the public property where
the pesticide application is to occur shall post the warning sign
required by this section.
  (5) The responsible public agency may substitute a barrier for
the warning sign to exclude public exposure to a treated area.
  (6) This section does not apply to a pesticide application by:
  (a) The Department of Transportation on a public highway right
of way.
  (b) The State Forestry Department on a state forestland.
  (7) As used in this section:
  (a) 'Pesticide' has the meaning given in ORS 634.006.
  (b) 'Public agency' means the agencies listed in ORS
634.660. + }
