                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Prohibits in-line skating without helmet and pads for child
under 12 years of age and without helmet for child between 12 and
18 years of age. Punishes violation by maximum of $25 fine.

                        A BILL FOR AN ACT
Relating to in-line skating.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) A person commits the offense of failure to
wear protective equipment while in-line skating if the person
in-line skates on a highway or premises open to the public and:
  (a) If the person is under 12 years of age, is not wearing
protective headgear of a type described under subsection (3) of
this section and is not wearing pads covering the person's knees
and elbows.
  (b) If the person is over 12 years of age and under 18 years of
age and is not wearing protective headgear of a type described
under subsection (3) of this section.
  (2) The offense described in this section, failure to wear
protective equipment while in-line skating, is a traffic
infraction punishable by a maximum fine of $25.
  (3) For purposes of this section:
  (a) 'Protective headgear' means headgear complying with the
standards and specifications for bicycle protective headgear
adopted by rule by the Department of Transportation pursuant to
section 6, chapter 408, Oregon Laws 1993.

  (b) 'In-line skating' includes but is not limited to roller
skating. + }
  SECTION 2.  { + (1) If a child in violation of section 1 of
this Act is 11 years of age or younger, any citation issued shall
be issued to the parent, legal guardian or person with legal
responsibility for the safety and welfare of the child.
  (2) If a child in violation of section 1 of this Act is at
least 12 years of age, a citation may be issued to the child or
to the parent, legal guardian or person with legal responsibility
for the safety and welfare of the child. + }
