                             SUMMARY

The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.

  Regulates parachuting facilities. Provides that parachuting
activities must occur at designated facilities and be conducted
so as not to constitute nuisance. Requires permit issued by
county.

                        A BILL FOR AN ACT
Relating to regulation of parachuting facilities.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this Act is added to and made a
part of ORS chapter 215. + }
  SECTION 2.  { + (1) Parachutists shall take off from, descend
over and land on only those areas where parachuting and skydiving
activities are permitted. Landing areas shall be specifically
designated for such uses and shall be cleared of obstructions and
conspicuously marked so as to facilitate landings that are safe
for the parachutists and do not endanger people on the ground.
  (2) Parachuting and skydiving activities, where otherwise
permitted, shall be conducted so as not to constitute a nuisance.
Aircraft engaged in these activities shall be properly maintained
in compliance with applicable state and federal aviation
regulations, including proper sound-muffling devices. Except for
ribbons or other wind-directional devices necessary for safe
parachuting and skydiving activities, no litter, leaflets or
other debris or material of any sort shall be discharged from
aircraft engaged in parachuting or skydiving activities.
  (3) A person conducting parachuting and skydiving activities
shall obtain a permit from the county where the activities will
occur. County approval of parachuting and skydiving activities
shall be conditioned as necessary to ensure compliance with the
standards of this section. A permit issued under this section
shall not be valid for a period of more than one year.
  (4) The activities of all persons engaged in parachuting and
skydiving, including parachutists, pilots and support personnel,
are subject to the provisions of this section.
  (5) Parachuting and skydiving activities include all of the
following:
  (a) Taking off of aircraft containing parachutists and
skydivers;
  (b) Landing on the ground after jumping or falling from an
aircraft;
  (c) All activities associated with preparation, packing,
testing, storage and repair of parachutes and related equipment;
and
  (d) Ground instruction. + }
