AN ACT
HB 2235
Relating to
maternal mental health; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. (1) The Maternal Mental
Health Patient and Provider Education Program is created in the Oregon Health
Authority. The goal of the program is to identify and address maternal mental
health disorders and to prevent the associated long-term negative outcomes from
the disorders that result for women, children and families.
(2) The authority shall develop
informational materials for health care providers who serve pregnant and
postpartum patients, including patients who have experienced a post-pregnancy
loss. The informational materials must be based on the recommendations made in
the report of the work group on maternal mental health disorders pursuant to
section 1, chapter 624, Oregon Laws 2009.
(3) The authority shall post the
informational materials developed under subsection (2) of this section to the
authority’s website to educate the public about maternal mental health
disorders.
SECTION 2. (1) Physicians, nurse
midwives and other licensed health care professionals who provide prenatal and
postnatal care to patients may provide to each patient, and family members of
the patient, if appropriate, the informational materials published by the
authority under section 1 of this 2011 Act or other maternal mental health
education materials that are approved by the authority.
(2) Hospitals and other health care
facilities that provide maternity care may give postnatal and post-pregnancy
loss patients, and family members of the patients, if appropriate, prior to the
discharge of the patient, the informational materials published by the
authority under section 1 of this 2011 Act or other maternal mental health
education materials that are approved by the authority.
SECTION 3. The Oregon Health
Authority is authorized to apply for federal grants that are available under 42
U.S.C. 280g-11, 711 and 712 or any other appropriate federal funding source,
and may solicit private gifts, grants or donations to carry out the provisions
of section 1 of this 2011 Act.
SECTION 4. (1) Sections 1 and 2 of
this 2011 Act become operative when the Oregon Health Authority receives
funding described in section 3 of this 2011 Act that is sufficient to carry out
the provisions of section 1 of this 2011 Act.
(2) The authority may take any action
before the operative date specified in subsection (1) of this section to obtain
the funding necessary to carry out the provisions of section 1 of this 2011
Act.
(3) Until the operative date specified
in subsection (1) of this section, the authority shall report on the status of
funding requests made under this section at each meeting of the interim Joint
Committee on Ways and Means or to each meeting of the Human Services
Subcommittee of the interim Joint Committee on Ways and Means.
SECTION 5. This 2011 Act being
necessary for the immediate preservation of the public peace, health and
safety, an emergency is declared to exist, and this 2011 Act takes effect on
its passage.
