Chapter 456

      456.055 to 456.235

NOTES OF DECISIONS

Housing Authorities Law and ORS chapter 457, governing creation of urban renewal agencies, are parallel statutory schemes, and thus identical provisions in the two acts will be given same effect. Housing Authority of Lane County v. Board of Commissioners, 35 Or App 785, 582 P2d 844 (1978), Sup Ct review denied

      456.095

NOTES OF DECISIONS

City council and housing authority were distinct entities with different functions even though their membership was identical, and cooperation agreement between council and authority did not obligate city to grant conditional use permit for any housing project approved by authority. Western Mills v. Housing Authority of Salem, 34 Or App 401, 578 P2d 817 (1978), Sup Ct review denied

      456.233

NOTES OF DECISIONS

“Return” of powers pursuant to this section reflects fact that assignment of municipal powers to independent body is delegation of powers, and thus county board of commissioners was authorized to reassign housing authority functions to itself regardless of whether those functions were initially retained by county board or were initially delegated to separately created county board. Housing Authority of Lane County v. Board of Commissioners, 35 Or App 785, 582 P2d 844 (1978), Sup Ct review denied

      456.315

      456.635

NOTES OF DECISIONS

The provisions of this section relating to insurance should not be “deleted and severed” as unconstitutional, but, rather, should be interpreted as preventing any contract of loan insurance except from special revenue funds. Gibson v. Smith, 20 Or App 264, 531 P2d 724 (1975), Sup Ct review denied

      456.680
