NOTES OF DECISIONS

 

      Methodology for rule interpretation is to look first at text and context, then if rule remains ambiguous, to look at intent of Council on Court Procedures in adopting rule. Gottenberg v. Westinghouse Electric Corp., 142 Or App 70, 919 P2d 521 (1996)

 

      Civil procedure rules do not govern procedure in appellate courts. McCarthy v. Oregon Freeze Dry, Inc., 327 Or 84, 957 P2d 1200 (1998), clarified 327 Or 185, 957 P2d 1200 (1998)

NOTES OF DECISIONS

 

      Oregon Rules of Civil Procedure do not apply to proceedings before Commission on Judicial Fitness and Disability. State ex rel Currin v. Comm’n on Judicial Fitness, 311 Or 530, 815 P2d 212 (1991)

 

      “Actions pending at time of or filed after their effective date” ordinarily refers only to actions pending before trial courts. Robinson v. Lamb’s Wilsonville Thriftway, 332 Or 453, 31 P3d 421 (2001)
