      In action for damages against title insurer, property owner could litigate issue of whether adverse possession had extinguished easement previously granted by property owner even though easement holder had not been made party. Miller v. Transamerica Title Ins. Co., 271 Or 622, 533 P2d 325 (1975)

 

In general

 

      This rule and [former] ORCP 16C, read together, allow plaintiff to assert alternative inconsistent claims against multiple defendants. Dotson v. Smith, 307 Or 132, 764 P2d 540 (1988)
