NOTES OF DECISIONS

 

      Preliminary injunction or restraining order is not effective until entered as written judgment. Kay v. David Douglas School Dist. No. 40, 303 Or 574, 738 P2d 1389 (1987)

 

      Because this rule provides adequate state remedy for protection of right to use water, trial court erred in awarding attorney fees for 42 U.S.C. 1983 claims under 42 U.S.C. 1988. Saylor v. Water Resources Dept., 100 Or App 745, 788 P2d 494 (1990), Sup Ct review denied

 

      Permanent injunction may issue prior to issuance of judgment in case. Oregon Education Association v. Oregon Taxpayers United PAC, 227 Or App 37, 204 P3d 855 (2009)
